The offence of driving with excess alcohol

Driving a vehicle with excess alcohol is a serious offence. This offence is committed if you drive or attempt to drive a vehicle whilst over the legal alcohol limit. The legal limit is 35mg per 100ml of breath, 80mg per 100ml of blood or 107mg per 100ml of urine.

Sentencing for being in charge of a vehicle with excess alcohol

Due to the seriousness of this offence it can only be dealt with in the Magistrates Court. You could receive a custodial sentence of up to six months, a community penalty and/or a fine of up to £5,000. You are also likely to be disqualified from driving for between twelve and thirty six months.

Available defences

There are a number of defences potentially available to you for the offence of driving with excess alcohol. Examples include:

  • You were not the one driving the vehicle
  • You were not driving on a road or public place
  • There were issues of reliability in relation to the breath testing equipment
