What is dangerous driving?

Dangerous driving is one of the more serious driving offences. To be found guilty of dangerous driving the prosecution need to prove that your driving fell below the standard of a careful and competent driver and it would be obvious to a careful driver that driving in such a way would be dangerous. Examples of dangerous driving include:

  • Competitive driving
  • Deliberate disregard of traffic signals
  • Driving on pavements
  • Dangerous overtaking

The offence of dangerous driving is not just restricted to you having driven a car in a dangerous manner but also includes driving a vehicle which is in a dangerous condition. If this was the case the prosecution would have to prove that you should have known driving a vehicle in such a condition would have been dangerous.

Sentencing for dangerous driving

If heard in the Magistrates Court the maximum fine is £5,000 and up to 6 months imprisonment. In the Crown Court you could receive an unlimited fine and up to two years imprisonment. A conviction for dangerous driving also carries a mandatory driving disqualification for one year.

Available defences

There are a number of defences potentially available for the offence of dangerous driving which depends upon the circumstances. Examples are:

  • You were not driving on a road or public place
  • The standard of your driving did not fall far below that of a competent and careful driver
  • Your vehicle was not in a dangerous condition or it would not have been obvious to a competent and careful driver that it was in such a dangerous condition
